    <span style="font-size:16px;line-height:150%;font-family: 宋体">近期，国家林业局及省能源局先后下发通知，进一步明确了支持光伏产业健康发展的有关要求和指导意见。为确保我省光伏电站项目做到科学选址、合理布局、依法依规使用林地，现就规范光伏电站建设使用林地相关事宜通知如下：</span>
</p>
<p style="text-indent:37px;line-height:150%">
    <span style="font-size:19px;line-height:150%;font-family: 黑体">一、充分认识规范光伏电站建设使用林地的重要性</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">建设光伏电站是国家鼓励发展可再生清洁能源的重要方式，但其用地面积大、运营期长、选址或建设方式不当极易对当地生态环境构成威胁和危害。特别我省的光伏电站主要规划布局在生态极端脆弱的干热河谷和石漠化地区，若林地使用不规范、监管不到位，势必加剧原有生态系统趋向恶化，水土流失也会更为严重，与我省争当全国生态文明建设排头兵的定位和建设西南生态安全屏障的要求相悖。切实对光伏电站建设的选址与使用林地类型进行规范，有利于协调解决好生态保护与能源发展的矛盾，有利于促进我省生态林业、民生林业及光伏产业健康发展。</span>
</p>
<p style="text-indent:37px;line-height:150%">
    <span style="font-size:19px;line-height:150%;font-family: 黑体">二、严格控制光伏电站选址和使用林地类型</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">严格执行《国家林业局关于光伏电站建设使用林地有关问题的通知》（林资发〔</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">2015</span><span style="font-size:16px;line-height:150%;font-family:宋体">〕</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">153</span><span style="font-size:16px;line-height:150%;font-family:宋体">号）规定，禁止占用自然保护区、国家公园、湿地、森林公园、濒危物种栖息地、天然林保护工程区等环境敏感区域的林地建设光伏电站。我省天然林保护工程区系指纳入全省天然林保护二期工程森林管护的国有林、集体所有的国家级公益林和地方公益林。光伏电站的电池组件阵列仅限于使用三种类型的林地：一是县级以上人民政府规划的宜林地，二是年降雨量</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">400</span><span style="font-size:16px;line-height:150%;font-family:宋体">毫米以下区域覆盖度低于</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">30%</span><span style="font-size:16px;line-height:150%;font-family:宋体">的灌木林地，三是年降雨量</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">400</span><span style="font-size:16px;line-height:150%;font-family:宋体">毫米以上区域覆盖度低于</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">50%</span><span style="font-size:16px;line-height:150%;font-family:宋体">的灌木林地。此外，建设光伏电站所使用林地的范围，必须严格按照林地保护利用规划进行界定，决不允许擅自修改调整林地保护利用规划。</span>
</p>
<p style="text-indent:37px;line-height:150%">
    <span style="font-size:19px;line-height:150%;font-family: 黑体">三、切实规范&quot;林光互补&quot;模式的电站用地</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">严格控制纯地面式光伏电站使用林地，引导光伏电站建设与高原特色农业、林业产业发展和精准扶贫相结合。利用森林资源调查确定为宜林地而第二次全国土地调查确定为未利用地的土地建设光伏电站的，用地范围应由当地林业、国土部门共同界定，保证按</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">&quot;</span><span style="font-size:16px;line-height:150%;font-family:宋体">林光互补</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">&quot;</span><span style="font-size:16px;line-height:150%;font-family:宋体">的用地模式和技术标准实施建设。电池组件覆盖密度不得超过</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">70%</span><span style="font-size:16px;line-height:150%;font-family:宋体">，最低架设高度不得影响地表灌草植被正常生长，间距应随地表灌草植被的生长作同步调整。凡有未经批准改变林地性质行为的，一律按违法占用林地查处。建设期间要尽最大努力减少对原生植被的破坏，运营期间要确保电池组件下的灌草植被能够正常生长。</span>
</p>
<p style="text-indent:37px;line-height:150%">
    <span style="font-size:19px;line-height:150%;font-family: 黑体">四、依法办理光伏电站建设使用林地审核审批手续</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">纳入国家光伏年度新增建设规模并经投资主管部门依法备案的光伏电站项目方能依法办理使用林地审核审批手续。光伏电站的逆变器室、生产区（包括升压站、配电室、控制室等）、生活区（包括办公、住宿、食堂、活动场所、库房等附属设施）和厂区道路等永久性建筑用地部分，按长期占用林地依法办理使用林地手续。光伏电站的电池组件阵列，采用</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">&quot;</span><span style="font-size:16px;line-height:150%;font-family:宋体">林光互补</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">&quot;</span><span style="font-size:16px;line-height:150%;font-family:宋体">用地模式的，电池组件阵列在施工期按临时占用林地办理使用林地手续，运营期由双方签订补偿协议，通过租赁等方式使用林地。运营期间如需改变林地用途、破坏森林植被的，必须依法办理使用林地审核审批手续；采用其他用地模式的，依法办理占用林地审核审批手续。建设单位在提交使用林地申请材料时，所提供的拟使用林地现状图要对第二次全国土地调查确定为未利用地的土地作出标注。</span>

<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">&nbsp;</span><span style="font-size:16px;line-height:150%;font-family:宋体">按照国家林业局《建设项目使用林地审核审批管理规范》关于</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">&quot;</span><span style="font-size:16px;line-height:150%;font-family:宋体">同时有占用和临时占用林地的项目，经有审核权的上级人民政府林业主管部门审核同意使用林地后，有关下级人民政府林业主管部门才能办理临时占用林地审批手续</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">&quot;</span><span style="font-size:16px;line-height:150%;font-family:宋体">的相关规定，为进一步优化审批程序、简化报批手续、提高审批效率、改进服务质量，根据《云南省人民政府行政审批制度改革办公室关于取消和调整一批行政许可项目的通知》（云审改办〔</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">2016</span><span style="font-size:16px;line-height:150%;font-family:宋体">〕</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">2</span><span style="font-size:16px;line-height:150%;font-family:宋体">号）规定，光伏电站占用和临时占用林地实行一体化办理，统一报省级林业主管部门审批。</span>
</p>
<p style="text-indent:37px;line-height:150%">
    <span style="font-size:19px;line-height:150%;font-family: 黑体">五、加强建设光伏电站使用林地的监管</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">各地要加强对光伏电站建设使用林地的监管，定期开展检查，严格实行临时占用林地期满后恢复林业生产条件验收制度，确保光伏电站建设依法依规使用林地。</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">&quot;</span><span style="font-size:16px;line-height:150%;font-family:宋体">林光互补</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">&quot;</span><span style="font-size:16px;line-height:150%;font-family:宋体">模式光伏电站要确保使用的宜林地不改变林地性质，禁止电池组件采用固定平铺方式，禁止光伏电站场地进行高强度削坡填沟，场地平整应当尽最大努力保护原有植被。积极探索支持光伏电站建设与防沙治沙、宜林地造林等相结合。</span>
